Effective Date. This Privacy Policy is effective as of the date you join the Sparky waitlist or enroll in the beta program, whichever comes first. It governs all data collected through toys.unimatch.dev and any successor domain.

1. Who We Are

Sparky is operated by Unimatch LLC, a limited liability company duly organized and existing under the laws of the State of Delaware, with its registered office at 11 South DuPont Highway, Suite 102, in the City of Dover, Delaware 19901, United States of America ("Company," "we," "us," or "our").

Sparky is an AI-powered voice companion designed for children ages 6 to 10. We take children's privacy seriously. This policy explains in plain language what data we collect, why we collect it, and what rights you have as a parent or guardian.

2. Who This Policy Covers

This Privacy Policy applies to three types of participation in Sparky. You may fit one or more of these categories at the same time.

Waitlist Participants

Adults who join our email waitlist to receive updates about Sparky. We collect only the information you provide on the signup form. No child data is collected at this point.

Web Beta Program Participants

Parents and guardians who enroll their children to use Sparky through our web interface. Children ages 6 to 10 interact with the AI under parental supervision and with verifiable parental consent. Section 5 (COPPA) applies in full.

Marketing and Research Communications

Anyone — waitlist members, beta participants, or others — who has opted in to receive product updates, surveys, launch announcements, or research invitations from Sparky.

3. What Data We Collect

3.1 Waitlist Data

When you join the Sparky waitlist, we collect only what you type into the form:

  • Your name (whatever you type — first name is fine)
  • Your email address
  • Age ranges of your children (e.g., 6–7, 8–10) — household-level information you provide as the parent
  • An optional free-text note if you choose to fill it in
  • Technical metadata needed to run the site: IP address briefly visible to our hosting provider for spam prevention, not stored alongside your waitlist record

We do not collect your child's name, photo, voice, location, or any direct identifier through the waitlist. The waitlist is filled in by you as the parent — no child interacts with this form.

Why we collect it: to tell you when Sparky becomes available, to size the first production batch, and to ask a few of you for feedback if you opt in. Our legal basis under GDPR is your consent, given when you submit the form. Under CCPA / CPRA this is treated as a request from you to be contacted.

3.2 Beta Program Account Data

When you register your family for the beta program, we collect:

  • Your full name
  • Your email address
  • Your child's first name or nickname (not full name)
  • Your child's age range
  • Your preferred language

3.3 Voice and Text Interaction Data (Beta Program)

When your child interacts with Sparky during the beta program:

  • Audio input is captured and processed to generate a response
  • Audio is transcribed to text immediately upon receipt
  • Audio recordings are not retained beyond the immediate transcription window (less than 60 seconds)
  • Text transcripts of conversations are stored for a maximum of 30 days to enable safety review and parental oversight, and are then permanently deleted

3.4 Marketing and Research Data

If you opt in to marketing communications or research participation, we may also collect:

  • Your communication preferences (email frequency, topics of interest)
  • Your responses to optional surveys regarding features, pricing interest, and product preferences
  • Your interactions with our emails (open rates, link clicks) — aggregated, not used for individual profiling
  • Your indication of interest in future Sparky products, hardware versions, or commercial releases

Marketing communications are always opt-in. You can unsubscribe at any time via the link in every email.

3.5 Technical Data

Across all forms of participation, we collect:

  • Device type and browser type (for compatibility purposes only)
  • IP address (used to determine country of access; not linked to a child's profile)
  • Session timestamps

4. What We Do Not Collect

  • Your child's full legal name, school, home address, or photograph
  • Biometric identifiers or voiceprints
  • Behavioral profiles for advertising purposes
  • Location data beyond country level
  • Any data from social media platforms
  • Data from children under 6 years of age

5. Children Under 13 — COPPA Compliance

Sparky is designed for children ages 6 to 10. The Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq., regulates how we collect personal information from children under 13.

COPPA does not apply to data we collect through the waitlist or marketing communications — because we collect information only from adults about their household, never from children directly.

COPPA applies in full to the Web Beta Program. We will obtain verifiable parental consent before collecting any personal information from a child under 13.

5.1 How We Obtain Verifiable Parental Consent

Before your child may use Sparky, we require you to:

We do not grant access to the Sparky service to any child under 13 until verifiable parental consent has been received and confirmed.

5.2 Your Rights as a Parent Under COPPA

At any time, you may:

  • Review all personal information we have collected about your child by contacting privacy@sparky.ai
  • Request deletion of your child's data — we will fulfill deletion requests within 30 days
  • Withdraw consent and terminate your child's participation in the beta program
  • Refuse to permit further collection of your child's data while still maintaining your own account

To exercise any of these rights: email privacy@sparky.ai with subject line: COPPA Data Request — [Your Name]. We will respond within 5 business days.

6. Who Can See Your Child's Data

6.1 Sparky Team

A limited number of Sparky engineers and safety reviewers may access conversation transcripts — only for the purpose of investigating a safety concern or technical issue, only under access logging and internal access controls, and never for advertising, profiling, or commercial purposes.

6.2 Third-Party Service Providers (Sub-Processors)

We share data with the following service providers solely to operate the Sparky service:

  • OpenAI— AI response generation. Text transcripts only. No training on children's data.
  • Vercel — Infrastructure hosting. Encrypted data at rest and in transit.
  • Resend — Email delivery. Used only to send transactional messages you have requested.

All providers are under contract prohibiting use of children's data for any purpose other than operating Sparky.

6.3 No Sale, No Advertising

We do not sell, rent, or share your child's personal information with advertisers, data brokers, or social media platforms. Ever.

7. Data Retention and Deletion

7.1 Waitlist Data

  • Waitlist record (name, email, age ranges): retained until you ask us to delete it, or until we decide Sparky will not ship — whichever is first
  • If you unsubscribe: record deleted within 30 days
  • To delete your waitlist record: email privacy@sparky.ai with one line

7.2 Beta Program Data

  • Audio recordings: deleted within 60 seconds of transcription
  • Text transcripts: deleted after 30 days
  • Parent account data: retained for the duration of the beta program and deleted within 30 days of program termination or account closure
  • Upon parental request: all data deleted within 30 days of verified request

7.3 Marketing and Research Data

  • Communication preferences: retained while you remain subscribed; deleted within 30 days of unsubscribing
  • Survey responses: retained in aggregated form for product research; individual responses deleted on request
  • To opt out: use the unsubscribe link in any email or email privacy@sparky.ai

8. Security

  • All data in transit is encrypted using TLS 1.2 or higher
  • All data at rest is encrypted using industry-standard AES-256 encryption
  • Access to production systems is logged, audited, and limited to the minimum required staff
  • In the event of a data breach affecting your child's information, we will notify you within 72 hours of discovery and notify relevant regulators as required by law

9. Cookies and Tracking

Our web interface may use limited session cookies strictly necessary for the service to function. We do not use advertising cookies, tracking pixels, or third-party analytics that identify individual users. For details, see our Cookie Disclosure.

10. Changes to This Policy

We may update this Privacy Policy from time to time as Sparky evolves. Continued use of the waitlist or beta program after updated versions are published constitutes acceptance of the updated policy.
